I Think My Head is Going to Explode.

Recently I was given a list of lawyers who make up the law firm of Robert L. Allen, Jr. (the Chair of the Brookline Selectmen). Listed among the barristers is “Richard Allen, Of Counsel.” Richard Allen? You mean Robert’s younger brother? Seems so.

Big deal? Well, Richard Allen is also a lieutenant in the Brookline Police Department. And given that Robert Allen advertises his services as including “criminal defense”, it would seem to me that a perp might see a benefit to hiring a law firm that has a top BPD officer on the letterhead as “of counsel.”

Besides, I always thought “of counsel” meant a graybeard that brought valuable experience to a firm on an as-needed basis. Richard Allen was admitted to the Bar in 2002.

Here’s a link to a Mass Office of Bar Counsel (Board of Bar Overseers) ethics article in the matter of “of counsel.”
